Terms and Conditions

It has been recorded and agreed:
The duration of the Tenant’s occupation of the Premises will be as indicated above.
The number of occupants of the Premises during the period shall be as indicated above.
It is been agreed that in order to confirm the provisional reservation the Tenant must ensure that
Capevillas.co.za receives the deposit referred to above, in cleared funds, by way of electronic transfer
or international wire transfer together with a duly completed and signed copy of this agreement.
The balance of the total amount owing in respect of the reservation shall be settled in cleared funds,
by way of electronic transfer or international wire transfer at least 30 days prior to the arrival date.
Cancellations: In the event of cancellation of the confirmed reservation more than 30 days prior to the agreed date of
arrival, Capevillas.co.za reserves the right to retain the full amount of the deposit. However SALTG will then open
the Calendar and should we get another rental overlapping the Tenants dates, tenant will be refunded accordingly.
In the event of cancellation of the confirmed reservation less than 30 days prior to the agreed date of arrival,
Capevillas.co.za reserves the right to retain the full amount of the rental cost.
We highly recommend that every person included in the booking has travel insurance for the entire duration of the Tenant’s
occupation of the Premises as the Owners Insurance does not cover guests. Which might also cover guests for their Deposit.
The refundable deposit will be withheld on the tenant’s credit card to cover damages to the property,
excluding fair wear and tear. Within seven days of departure Capevillas.co.za shall provide the Tenant
with invoices and proof to substantiate any damage claim prior to being drawn from the deposit.
In our experience this happens very rarely and we are not overly concerned about a couple of glasses
broken but we will act in the best interest of the villa (Premises) and its owner to repair any damage.
Events, parties or any loud noise is not allowed and may lead to guests being asked to leave.

Please be further advised that the Tenant’s liability for damage to the property and its contents is not
limited to the refundable security deposit.
Any unsuitable behavior, late night noise resulting in complaints could lead to immediate eviction.
The number of occupants shall at no time during the currency of this agreement exceed the amount of
PAX on this document unless an arrangement has been made.
The Tenant who makes a booking thereby warrants his/her authority on behalf of all persons included
in the booking to agree that all such persons shall be bound by the terms and conditions of this rental
agreement. The Tenant indemnifies Capevillas.co.za and the Owner against any claim by any such person
to the extent the Tenant would not himself be entitled to make such claim under this lease.
The Tenant shall use the Premises only for residential accommodation and any commercial activity must
be expressly authorized prior to occupation. Without prejudice to the rights of the Owner, if any unauthorized
commercial activity occurs, the rental rate for the period will be double (2 times) the agreed rate.
The Tenant shall notify Capevillas.co.za within 24 hours after the date of arrival of any defects in the Premises
and shall, if the Tenant has not notified Capevillas.co.za or the property manager as aforesaid, be deemed to
have acknowledged that the Premises were received in good condition.
All villas are booked by the Client as per the description and details presented to the Client by the Villa
and/or the Premises page as seen on the website Capevillas.co.za cannot be held as the responsible party
should the client be unhappy with the Client’s choice of premises.
The Tenant shall keep the Premises in a clean, tidy and sanitary condition.
The Tenant shall not cede any of its rights or delegate any of its obligations under this agreement.
The Tenant shall not sub-let, permit anyone else to occupy or part with possession of the Premises
or part thereof.
To the maximum extent permitted by law, the Tenant shall not have any claims of any nature
against Capevillas.co.za or the owner for any loss, damage, injury or death which the Tenant may directly
or indirectly suffer save for negligence on the part of the Owner.
The Tenant shall have no claims against Capevillas.co.za and the owner from any constructional work happening
around but not on the “Premises’.
The Tenant shall not be entitled to keep or to bring onto the Premises any pets without the prior written
consent of Capevillas.co.za
The Tenant will comply with any reasonable house rules imposed by the Owner or Capevillas.co.za.
If the Tenant becomes aware of any item requiring repair (e.g. a leaking pipe) the Tenant will promptly
advise the Agent of same.
The Tenant will not keep anything on the premises that are or could be dangerous or hazardous (e.g., fireworks).
This lease is governed by the laws of South Africa. The courts of South Africa shall have exclusive jurisdiction
in respect of any claims arising therefrom.
The Tenant shall ensure that the housekeeper is given daily access to the premises for cleaning purposes.
Each paragraph, clause, term, and provision of this Agreement and any portion thereof shall be considered
severable and if, for any reason any part of this Agreement is held to be invalid, contrary to, or in conflict with
any applicable present or future law or regulation (including, without limitation, the CPA) or in terms of
a final, binding applicable present or future law or regulation (including, without limitation, the CPA) or in
terms of judgment issued by any Court, it shall not impair the operation of, or have any other effect upon, such
other portions of this Agreement as may remain otherwise intelligible, which shall continue to be given
full force and effect and bind the parties hereto.
